Sweet, Judge, granting motion of receiver for a declaration that debts of defendant Credit Bancorp, Ltd., et al., to its customers have priority over its tax liabilities to the United States, and that the receiver may use and distribute receivership assets without paying, providing for, or being held personally liable for under the Federal Debt Priority statute, 31 U.S.C. § 3713, federal tax obligations of defendants or the receivership. See 138 F.Supp.2d 512 (2001). Vacated and remanded for dismissal of receiver's motion for lack of jurisdiction, on the ground of sovereign immunity.
